Hermès claims that the artist under the pseudonym Mason Rothschild continues to promote NFT , despite the recent court decision. At the same time, he receives 7.5% of royalties from sales. Hermès demands to transfer all remaining NFT to the fashion house.

U.S. District Judge Jed Rakoff said the permanent injunction should be effective because Rothschild’s ongoing marketing is likely to confuse consumers and cause irreparable harm to the company.  Rakoff rejected Rothschild’s requests to overturn the verdict or hold a new trial.
